I Can’t Pay My Credit Cards; How Do I Pay You?

Janey came into my office for her free consultation on her possible bankruptcy. After we reviewed her personal situation, I determined she would be the perfect candidate for a Chapter 7 bankruptcy, wiping out all her credit card debt. She also wanted to surrender her car as she realized she was spending way too much each month on it. We talked about price. She said, “if I can’t pay my credit card bills and I can’t pay my car payment, how can I pay you?” I told her to stop paying the credit cards and stop paying the car payment right now. She will have enough for my fees in two months. Most creditors will start calling her after about 30 days, but won’t take any permanent action to repossess the car or file a lawsuit on the credit cards until after 90 days. By then, we’ll have her bankruptcy filed, she will have saved a few months of payments, and she’ll be able to give the car back and buy a much less expensive one for cash.
